Scenario: You’re trying to buy a home. Why not just call the listing agent and go see the home and make an offer if you like it?
First, all agents by law now have to get you to sign a Buyer Representation Agreement as of summer 2024. Yes, agents used to be able to take you to see homes without a signed agreement, but we can’t do that anymore.
No licensed agent can get you into a home without you signing that document.
Okay, fine, so why would I not just do that with the listing agent?
Reality: The listing agent is already representing the seller. Yes, legally, that agent can represent both the seller and the buyer. This is called Disclosed Dual Agent.
But, if one agent is representing two clients and negotiating deals for both parties, this means that one person holds confidential information and negotiating strategies for both parties. It is similar to using one lawyer for both sides of a legal matter. We all know this isn’t a good idea in the matter of law! And it’s not a good idea in real estate. If you want an agent who is fiduciary to you and only you, you need a buyer’s agent.
Purchasing a home is one of the most important and expensive decisions you will ever make, and will affect your whole life. Finding a lender to negotiating a great deal to moving to a new community to possibly selling another home in another community, real estate transactions can be stressful without someone who represents you and only you to get the best possible deal for you and only you. That’s why you need your own agent in your own corner, and why it is not advisable to try to use the listing agent to represent both sides of a transaction.
